This Rental Agreement (the "Agreement") sets forth the terms and conditions under which Boreal At Home Comfort & Mobility Services ("Lessor," "we," "us," or "our") rents medical equipment to the Renter ("Client," "you," or "your"). By placing an order and accepting delivery of equipment, you agree to be bound by these terms and conditions.
2.1 The Rental Period begins on the date the Equipment is delivered and set up at your specified location and concludes on the date the Equipment is picked up by Lessor.
2.2 Rental Fees are calculated based on the selected Rental Option (1, 3, 6, or 12 months) as displayed on our website and in your order confirmation. All multi-month rental fees are due in full upfront at the start of the Rental Period.
2.3 The One-Time Fee is applied per rental order and covers delivery, setup, and pickup within our standard service area. This fee may vary based on the selected Rental Option (as displayed on our website) and your location. Additional charges may apply for deliveries/pickups outside of our standard service area.
2.4 Overdue payments will incur a late fee of 2% per month on the outstanding balance, calculated from the original due date.
3.1 A security deposit of $250 (the "Security Deposit") may be required for each rental. This Security Deposit will be collected at the time of the order and is held against potential damages to the Equipment beyond normal wear and tear, or for any unpaid fees.
3.2 The Security Deposit will be refunded to the Client within 5 business days following the satisfactory return and inspection of the Equipment, less any deductions for damages, excessive cleaning required, or outstanding fees.
4.1 Lessor will deliver and set up the Equipment at the address specified by the Client during the order process, typically within 1-2 business days of order confirmation, subject to availability and scheduling.
4.2 The Client must ensure clear access to the delivery location and that the space is prepared for the Equipment's setup.
4.3 At the end of the Rental Period, it is the Client's responsibility to notify Lessor to schedule a pickup. The Equipment must be ready for pickup on the agreed date and time.
5.1 The Client acknowledges receiving the Equipment in good working order and clean condition. Lessor will inspect the Equipment upon return.
5.2 The Client agrees to use the Equipment solely for its intended purpose and in a careful and proper manner. The Client is responsible for any damage to the Equipment beyond normal wear and tear that occurs during the Rental Period.
5.3 Any repairs or excessive cleaning required due to misuse or damage by the Client will be charged to the Client, potentially deducted from the Security Deposit or billed separately.
5.4 The Client is responsible for any personal injury or property damage resulting from the improper use of the Equipment.
5.5 The Client agrees not to modify, alter, or attempt to repair the Equipment.
6.1 Lessor is responsible for the routine maintenance and repair of the Equipment due to normal wear and tear.
6.2 If the Equipment malfunctions due to normal wear and tear, the Client must notify Lessor immediately. Lessor will arrange for repair or replacement of the Equipment within a reasonable timeframe (e.g., 24-48 hours).
7.1 If you wish to extend your rental beyond the initial Rental Period, you must notify Lessor at least 5 business days prior to the end of your current term. Extensions are subject to Equipment availability and will be billed at the then-current monthly rate (unless a new multi-month package is agreed upon).
8.1 **Cancellation of Order Prior to Delivery:** If an order is cancelled by the Client prior to the Equipment being delivered, a cancellation fee of $99 may apply, or a full refund may be issued if cancelled within 24 hours of order confirmation.
8.2 **Non-Refundable Policy for Multi-Month Rentals:** All payments for multi-month rental packages (3, 6, and 12-month options) are **non-refundable after 7 days** from the start date of the Rental Period (i.e., delivery date). This policy is in place to allow us to offer significantly discounted rates for longer commitments.
8.3 **Early Termination of Monthly (1-Month) Rental:** If a 1-month rental is terminated early by the Client, no refund will be issued for the unused portion of the month.
8.4 **Early Termination of Multi-Month Rentals:** In the event of early termination by the Client for a 3, 6, or 12-month rental package *after the 7-day non-refundable period*, no refund will be issued for the unfulfilled portion of the rental term. Lessor reserves the right to retain the full upfront payment for the agreed-upon multi-month rental period.
8.5 **Termination by Lessor:** Lessor reserves the right to terminate this Agreement and retrieve the Equipment immediately if the Client breaches any terms of this Agreement, including but not limited to, non-payment of fees or misuse of the Equipment.
9.1 Lessor shall not be liable for any direct, indirect, incidental, special, or consequential damages (including, but not limited to, loss of profits, revenue, or use) incurred by the Client or any third party, whether in an action in contract or tort, arising from your access to, or use of, the Equipment, even if Lessor has been advised of the possibility of such damages.
9.2 The Client agrees to indemnify, defend, and hold harmless Lessor, its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to the Client's use or misuse of the Equipment, or any breach of this Agreement.
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under this Agreement shall be resolved in the courts of Ontario.
This Agreement constitutes the entire understanding between the Client and Lessor concerning the rental of the Equipment and supersedes all prior agreements and understandings, whether written or oral.
